Individuals with expired I-94s urged to avoid travel, even domestic, in light of recent ICE activity
There is currently an increased risk to individuals who have an expired I-94, and they should consider postponing domestic air travel:
- Even if they have a timely filed extension that is pending, and
- Even if they have a pending adjustment of status (AOS, or green card) application
Foreign nationals should hand-carry their passport, their most recent approval notice and/or I-94 from last entry if unexpired, valid EAD (if applicable), and recent paystub (if maintaining a work visa) even when flying domestically.
Those with an expired I-94 who still choose to travel have an increased risk of being detained by ICE or questioned heavily. In addition to the above, they should hand-carry proof of the timely filed nonimmigrant visa (NIV) extension petition, such as the receipt notice.
