USCIS Now Issuing AOS-based EADs for 5 Years

The USCIS has begun implementing its new policy of issuing Employment Authorization Documents (EADs) with five year validity for several categories of EAD applicants, including employment- and family-based adjustment of status (AOS) cases.  

The change applies to both initial and EAD renewal applications filed on or after September 27, 2023, in the qualifying categories. 

In its announcement, the USCIS stated that by extending the validity period of these EADs the agency hopes to reduce the number of future applications and therefore reduce processing times. 

Weaver Schlenger has also observed that the USCIS is issuing Advance Parole documents (APs) for the same five year period to AOS applicants.
