USCIS to Further Expand Premium Processing to Certain Pending I-140s

The USCIS has announced a second phase of the expansion of premium processing for certain pending I-140 petitions.

As of August 1, 2022, there are new filing dates under which the USCSIS will accept Form I-907 (Request for Premium Processing) upgrades:

• EB-1C Multinational Executive and Manager Petitions received on or before July 1, 2021 (previous date was March 1, 2021)
• EB-2 National Interest Waiver (NIW) Petitions received on or before August 1, 2021 (previous date was June 1, 2021)

The time frame for premium processing upgrades for the two petitions above will be 45 days.

The USCIS previously announced the expansion of premium processing to additional case types. Under its phased in approach, the USCIS plans to expand premium processing to Forms I-539 and I-765 as well, at a later date to ensure no adverse impact on processing time for other immigration benefits.
