USCIS Announces Delay in Data Entry and Receipts for FYH Cases

The USCIS has announced that due to COVID-19 required health and safety protocols, there will be delays in their usual timeframe for data entry and issuance of receipt notices until at least May 1, 2020.   

The USCIS said that receipt notices, when issued, will retain the receipt date that corresponds with the date the petition is received by the USCIS service center. Further, they will complete the intake processing in the order of receipt. 

The announcement indicated that “due to delayed data entry and notice generation, there will be a general delay in processing FY 2021 cap-subject petitions. We are mindful of petitions with sensitive expiration and start dates, such as cap-gap petitions, and will strive to process these petitions as efficiently as possible.”  

The USCIS has also indicated that they may transfer cases filed at one Service Center (as indicated on the H-1B registration selection notice) to another in order to balance workflows and increase efficiency. Petitioners and attorneys will be notified if this happens.
