SF Chronicle: Employers Receive More H-1B RFEs for Level 1 Occupations

The business section of today’s San Francisco Chronicle featured an article discussing the more frequent occurrence of Requests for Evidence (RFE) received by employers sponsoring H-1B employees.   The new normal for employers and immigration attorneys will require more preparation and advocacy, even for H-1B extension or change of employer situations.  As we’ve previously discussed, the Trump Administration has taken steps designed to curtail legal immigration under the auspices of detecting fraud and visa abusers. We recommend that employers who hire H-1B, L-1 and other nonimmigrant workers take proactive steps to protect themselves in case of an enforcement action.
