Plenty of 2010-2011 Fiscal Year H-1B Visas Remain

Employers can feel optimistic about hiring foreign nationals this fall who need cap subject H-1B visas. The USCIS reports that less than 38,000 cap subject H-1B petitions were filed against the 65,000 annual quota, and less than 14,000 H-1B petitions for holders of US MS/PhD degrees against the 20,000 additional set aside. Employers should file as soon as feasible, however. Last fall saw an increasingly upward trend in filings, culminating in a race against the clock in December, when H-1B visas ran out.
