District Court Rules that USCIS May Not Require New Forms as of 10/15/2019, Enjoins Public Charge Rule in General

Today, a District Court enjoined the USCIS from implementing the new public charge rule, and specifically said it cannot mandate the use of new forms starting October 15. The USCIS had published the new forms only yesterday on its website. These forms are:

  • Form I-485
  • Form I-129
  • Form I-539
  • Form I-864 and Form I-864EZ
  • Form I-944

USCIS's failure to publish the revised and new forms earlier provided little advance notice for employers, attorneys and applicants to prepare.

Weaver Schlenger welcomes this update because it allows employers and employees to continue to prepare and file requests for extensions/amendments of nonimmigrant status and change of employer, and adjustment of status applications.
