USCIS Resumes Premium Processing for Fiscal Year 2019 H-1B Petitions, Nearly 4 Months After 10/1/2018 Start Date

January 28, 2019

Today, the USCIS will resume premium processing of Fiscal Year 2019 (FY 2019) H-1B petitions.  Employers who have not yet heard on the FY 2019 petitions filed last April may now request the premium processing service. Likewise, employers who are in the process of responding to Requests for Evidence (RFEs) may file responses with the premium processing request.  The fee for premium processing went up to $1,410 last fall.

Meanwhile, the suspension of premium processing for other types of H-1B petitions (change of employer, amendment) remains until “agency workloads permit.”  Previously, the USCIS indicated the suspension would last until February 19, 2019 but it is not clear if that date will be honored.

We will continue to post updates as they become available.
