Visa Numbers Other than EB-1 Unavailable for Remainder of September, 2010

Disappointing News from USCIS which will affect all pending applications for family based and employment based adjustment of status (except based on EB-1 First Preference) for the remainder of September. On September 15, the State Department informed the USCIS that visa numbers for all categories (except EB-1 First Preference) were reached, and so, starting September 16 and for the remainder of the fiscal year, no more visas were available. Fortunately, the fiscal year ends in less than 10 days. The new fiscal year begins October 1, 2010, and with that, applicants for adjustment of status whose priority dates are current may expect processing to resume on their cases.
