USCIS Has Reached Fiscal Year 2018 H-1B Cap

The USCIS announced today that it has received the allocated 65,000 H-1B employer petitions available under the fiscal year cap (FY 2018).  It has also received more than the available 20,000 U.S. Masters degree H-1B requests.  A lottery will be held, though no specifics on the timing were provided by USCIS. 

 The USCIS previously announced that they would suspend premium processing on all H-1B petitions for at least 6 months.  This includes cases filed under the FY 2018 cap, as well as extension and change of employer requests.

All cases not selected for the lottery will be returned, including fees. 

Weaver Schlenger expects that employers will hear whether their petitions were accepted beginning in the next several weeks.
