Too True Not to Share: The New Normal for Immigration Lawyers

We are sharing a blog post by attorney Sandra Feist of Grell Feist PLC because she has expressed better than we could the frustration we are feeling with the government’s emboldened behavior to issue Requests for Evidence (RFEs) on cases that clearly meet regulatory qualifications for H-1B status. As Ms. Feist describes, the USCIS is issuing RFEs on whether a physician is a specialty occupation. They are exhibiting “passive aggressive” behavior by changing standards of adjudicating H-1Bs without going through the process of notice and comment to amend regulations.
