Weaver, Schlenger & Mazel will hosted an in-house Employer Compliance Training Session on April 17, 2007, with a teleconference on April 18, 2007 for national clients. Daily news reports of immigration raids at worksites mean that immigration enforcement is on the rise, and not only for employers with illegal workers or contractors on site. Employers who lawfully hire foreign nationals are subject to random and targeted I-9 and Labor Condition Application audits. Employers should also anticipate back door audits related to affirmative action and other areas. When the government auditor knocks on your door, will you pass or fail? Innocent paperwork violations could lead to fiscal penalties and increased scrutiny of an employer’s other employment practices. The Citizenship & Immigration Services recently established a fraud unit based out of the local San Francisco office, responsible for investigating and enforcing employer compliance. Expect enforcement in many cities. Immigration & Customs Enforcement (ICE) is the largest investigative arm of the Department of Homeland Security. According to the New York Times, criminal charges brought by ICE against employers have increased more than 1000% (one-thousand percent) since 2002. Employer compliance with federal laws, including immigration laws, is a critical action item for 2007. Weaver, Schlenger & Mazel offers Human Resource Teams, Corporate Counsel and other interested parties full service training, providing the basic tools to help your company to not only survive, but even shine through a government audit.
