FY H-1B 2012 Update: USCIS Says No Lottery in Break with Tradition

As if there were magically the right amount of numbers to match up with the number of FY petitions filed on November 22, 2011, the last date on which the USCIS accepted FY cases, the USCIS announced today that  it will not need to hold a lottery of H-1B cap-subject cases filed on that final day of filing for fiscal year 2012 (FY12).  Rather, all petitions properly receipted as of November 22 will be issued a receipt number and processed, the USCIS said.  We look forward to the data on the set-aside of Chilean and Singaporean numbers to back this up.

The USCIS relates that it will reject H-1B cases received after November 22, 2011. It has not mentioned holding a lottery yet for cases received yesterday. Stay tuned.

 
FY H-1B Numbers Likely to Run Out Within Next Week

Only a few thousand FY H-1B numbers remain, with about 5000 FY H-1B visa petitions received by the USCIS between November 14 through November 18. The USCIS reported today that as of November 18, it has received 61,800 subject cases.  There are no more MS degree numbers available.  When the government closes off the last day it will accept FY H-1B filings, it historically holds a “lottery” to randomly select FY cases for further processing.  Employers will be in limbo until receipts are issued.  When FY H-1B numbers are exhausted, employers will need to wait to file until April 1 for H-1B start dates of October 1, 2012, the beginning of the 2013 fiscal year.
 
WSMers Get into the Holiday Spirit by Volunteering at SF Food Bank

The team at Weaver Schlenger Mazel headed to the San Francisco Food Bank last night to package healthy food for local folks in need.  After donning our hairnets, we and the other volunteers sorted and bagged 3,000 pounds of brown rice into one-pound bags, and put together 1,000 pounds of cheese-and-cracker snacks.  Playing a critical role in fighting hunger, the SF Food Bank provides food to more than 200,000 people each year through its partnerships with 450 nonprofits.  Its warehouse holds more than 2 million pounds of food at any given time!  We felt fortunate to be able to lend a hand and work alongside others in our community.
