Plenty of 2010-2011 Fiscal Year H-1B Visas Remain |

Employers can feel optimistic about hiring foreign nationals this fall who need cap subject H-1B visas. The USCIS reports that less than 38,000 cap subject H-1B petitions were filed against the 65,000 annual quota, and less than 14,000 H-1B petitions for holders of US MS/PhD degrees against the 20,000 additional set aside. Employers should file as soon as feasible, however. Last fall saw an increasingly upward trend in filings, culminating in a race against the clock in December, when H-1B visas ran out.

Visa Numbers Other than EB-1 Unavailable for Remainder of September, 2010 |

Disappointing News from USCIS which will affect all pending applications for family based and employment based adjustment of status (except based on EB-1 First Preference) for the remainder of September. On September 15, the State Department informed the USCIS that visa numbers for all categories (except EB-1 First Preference) were reached, and so, starting September 16 and for the remainder of the fiscal year, no more visas were available. Fortunately, the fiscal year ends in less than 10 days. The new fiscal year begins October 1, 2010, and with that, applicants for adjustment of status whose priority dates are current may expect processing to resume on their cases. The Department of State has released the October Visa Bulletin!! The Dominican Republic is no longer included in the family and employment-based numbers.
Here are the stats:
EB1 - all still current
EB2
All others - still current
China –at May 8, 2006, advancing 2 whole weeks to May 22, 2006
India – NO CHANGE, still mired at May 8, 2006
Dominican Republic – still current
Mexico - still current
Philippines - still current
EB3
All others – at December 15, 2004, advancing 3 weeks (golly) to January 8, 2005
China – at October 22, 2003, advancing about 2 weeks to November 8, 2003
India – at January 1, 2002, advancing about 2 weeks to January 15, 2002
Dominican Republic – at June 1, 2004, advancing 6 ½ months to December 15, 2004
Mexico – presently “Unavailable,” but will be at April 22, 2001
Philippines – at December 15, 2004, advancing 3 whole weeks to January 8, 2005

The Department of State just released the August 2010 Visa Bulletin, with some notable improvement (only in comparison to previous months) for EB-2 Indian foreign nationals and EB-3 all other nationalities. |
