Slowdown in H-1B Processing |

Be aware that the USCIS has significantly slowed down processing of H-1B visa petitions, particularly at the California Service Center. Some cases have been pending over four months. Delays in adjudication can cause challenges with international travel, and in some instances, in renewing driver’s licenses. Employees should check requirements of their state DMV offices ahead of time. There is always the option of rewarding the government for its slowdown – paying a $1000 filing fee to upgrade the case to a 15 day adjudication timetable via premium processing. |

USCIS Increasing Filing Fees Starting November 23, 2010 |

The USCIS issued a press release and fact sheet today that filing fees will go up on many petitions by an average of 10%. Premium processing will cost $1225. |

State Department Announces No More Permanent Visas Available Until October 1st |

Last week, on September 15, 2010, the State Department notified the USCIS that it had used up all family and employment based visa numbers for the rest of the fiscal year ending September 30, except for the EB-1 employment based first preference category. Individuals can still file adjustment of status applications for the remainder of September if their visas were current according to the September Visa Bulletin released in mid August. Starting October 1, the USCIS will resume final adjudication on applicable adjustment of status cases. |

Annual Diversity Visa (DV) Lottery Begins October 5th |

The Department of State is giving out 50,000 visas again to DV Lottery Winners. The online registration for DV-2012 DV Lottery begins noon, Eastern Daylight Time (EDT), Tuesday, October 5, 2010, and ends noon, Eastern Daylight Time (EDT), Wednesday, November 3, 2010. Once again, the State Department warns folks to apply early. There are no changes this year to the list of eligible nationalities. H-1B Multiple Entry Visas for China |

The U.S. Department of State recently amended the visa reciprocity schedule to allow Chinese nationals to be issued H-1B visa stamps valid for 12 months and for multiple entries. [Chinese nationals previously were allowed H-1B visa stamps for a maximum period of three months and two entries.] The amended visa reciprocity schedule also applies to H-4 visas as well as all of the other H-1B categories. |
